Terms of Service

These Terms of Service (the “Terms”) govern your use of Sit and Tell (the “Service”). Sit and Tell is operated by Brandon Burton as a sole proprietor (“we,” “us,” or “Sit and Tell”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.

The service

Sit and Tell sends one question each week to a chosen family member and uses AI to ask a gentle follow-up that draws out the story behind each answer. Family members can read and keep those answers, and can add their own questions. We may change or improve features over time.

Eligibility and accounts

You must be at least 18 years old to buy a subscription or set up an account. Signing in uses a one-time link sent to your email, so please keep your email account secure. Anyone with access to your email may be able to access your account. You are responsible for the information you provide and for activity under your account.

Your content and who owns it

The questions, answers, and other material you and your family members add (“Your Content”) belong to you. We do not claim ownership of Your Content. You grant us a limited license to store, process, display, and transmit Your Content for the sole purpose of operating the Service for you and your family. For example, saving an answer, generating a follow-up question, and showing answers to the family members you are paired with. This license ends when the content is deleted, except for copies that may remain in routine backups for a limited time.

How your content is processed

To generate follow-up questions, we send the relevant question and answer text to the Anthropic API. If you use voice input, your audio recording is sent to OpenAI to turn it into text, and follow-up questions may be read aloud using OpenAI text-to-speech. These providers process the content only to perform these tasks. We do not sell Your Content, and it is not used to train AI models. See our Privacy Policy for more detail.

Subscription, billing, and renewal

Sit and Tell is offered as a single annual subscription at the price shown at checkout. Payments are processed by Stripe; we do not store your full card details. Unless you cancel, your subscription renews automatically each year at the then-current price, and the payment method on file will be charged. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.

90-day money-back guarantee

We offer a 90-day, no-questions-asked money-back guarantee. If you are not happy with Sit and Tell for any reason, contact us at hello@sitandtell.com within 90 days and we will refund your subscription in full. The 90-day window runs from the date of your purchase or most recent renewal payment. After 90 days, payments are non-refundable except where required by law.

Acceptable use

Please use Sit and Tell only for its intended, personal, family use. Do not use it to upload unlawful content, to harass anyone, to violate the rights of others, to attempt to access the data of another family, or to disrupt or reverse engineer the Service.

Third-party services

The Service relies on trusted providers, including Supabase (database and authentication), Anthropic and OpenAI (AI features), Stripe (payments), and Resend (email). Your use of the Service is also subject to the terms of those providers where applicable. We are not responsible for the practices of third parties.

Cancellation and account deletion

You may cancel your subscription, or delete your data entirely, from your account settings. The account holder can choose to keep the answers in their family readable after canceling, or to permanently delete them. Permanent deletion removes the questions, answers, and related records for your family and cannot be undone. You may also contact us to request deletion. See the Privacy Policy for details.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated questions will be accurate or suitable. You are responsible for the answers you choose to share.

Limitation of liability

To the fullest extent permitted by law, Sit and Tell and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles.

Dispute resolution and arbitration

Please read this section carefully, as it affects your legal rights. Most concerns can be resolved quickly, so we ask that you first contact us at hello@sitandtell.com before starting a formal dispute.

Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be settled by binding arbitration on an individual basis, rather than in court, except that either party may bring a qualifying claim in small-claims court. The arbitration will take place in California, or remotely where available, under the rules of a recognized arbitration provider, and the decision of the arbitrator will be final and binding.

To the fullest extent permitted by law, you and Sit and Tell agree that each may bring claims against the other only on an individual basis, and not as a plaintiff or class member in any class or representative action. You may opt out of this arbitration agreement by emailing us at hello@sitandtell.com within 30 days of first accepting these Terms. Nothing in this section prevents either party from seeking injunctive relief in court for the misuse of intellectual property or unauthorized access to the Service.
